Terms of Use of MakerWorld

Effective as of September 22, 2023.

 

PLEASE READ CAREFULLY AS USE OF THE SERVICES CONSTITUTES ACCEPTANCE OF AND BINDING AGREEMENT TO THESE TERMS OF USE.

These terms and conditions ("Terms of Use") govern your access to and use of products, software, services, and the web site of makerworld.com (collectively "Services") provided by MakerWorld Singapore Pte. Ltd. and/or any other related entity whether in existence now or in the future (collectively referred to herein as "we," "us," and/or "MakerWorld") , and any and all information and content, such as text, graphics, images, videos or other materials uploaded, downloaded, or appearing on the Services (collectively "Service Content"). The Services may also include, but are not limited to Bambu Store, Bambu Handy, and Bambu Studio, each being provided by Bambu Lab and/or its affiliated entities (collectively "Bambu Lab").

By accessing and using the Services, you are agreeing to be bound by and to comply with these Terms of Use. Wherever used in these Terms of Use, "User," "you," "your" or similar terms mean the person or legal entity utilizing or accessing the Services. IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS OF THE TERMS OF USE WITHOUT MODIFICATION, PLEASE DO NOT ACCESS OR USE THE SERVICES.

1. Your Access to the Services

No one under 13 years old is allowed to use or access the Services. By using the Services, the User states and confirms that:

  • The User is at least 13 years old;
  • The User is over the minimum age required by the laws of your country of residence to form a binding contract (the "age of majority"), or, if the Users are over 13, but under the age of majority in your country of residence, that your legal guardian has reviewed and agrees to these Terms of Use on your behalf;
  • The User is not otherwise prohibited from using the Services under any and all applicable laws; and
  • The User has not been permanently suspended or removed from the Services.

If the User is accepting the Terms of Use on behalf of another legal entity, including a business or government entity, such as an employer, the User represents that they have full legal authority to bind such entity to these Terms of Use.

2. Privacy

MakerWorld and Bambu Lab’s Privacy Policy explains how and why we collect, use, and share information about the User through the User’s access to and use of the Services. The User understands that, through your access to and use of the Services, the User consents to the collection and use of this information as set forth in the Privacy Policy.

3. Your User Account and Account Security

In order to access some functionalities and/or parts of the Services, you must be a registered user by creating a Bambu Lab & MakerWorld account (hereinafter "User Account"), which will include a username and password (collectively "login information"). If you create a User Account, you agree to provide your valid email address, and any other information requested in order to complete the user account registration process. You also agree to provide accurate information and to keep such information current. You may not use a username that attempts to impersonate another person, or violates the rights of others, as determined in our sole discretion.

The User Account also can be registered using an existing Bambu Lab Account Service (such as an account already registered with Bambu Lab) or a third-party login (such as a Google Account, an Apple ID, a Facebook account). The use of the Bambu Lab Account Service, or the connection of your third-party account through a third-party login tool, is governed by the applicable terms and conditions that the User is obliged to comply with.

All personal information provided for access to the Services will be handled in accordance with the Privacy Policy.

You are solely responsible for maintaining the security of your login information and for any activities or actions occurring under your User Account. You are responsible for keeping your password confidential and for immediately notifying us at support@makerworld.com, if your password has been compromised.

MakerWorld is not responsible for any losses caused by any unauthorized use of your User Account. However, you may be responsible for our losses or the losses of others due to such unauthorized use. We reserve the right to restrict or terminate your access to the Services or any feature or part thereof at any time and for any reason. You agree that we may send to you in electronic form any notices or other communications regarding the Services.

The User also agrees not to license, sell, or transfer your User Account without our prior written approval.

4. Your Use of the Services

Subject to your complete and ongoing compliance with these Terms of Use, MakerWorld grants the User a personal, non-transferable, non-exclusive, revocable, limited license to: access and use the Services. We reserve all rights not expressly granted to the User by these Terms of Use.

Except and solely to the extent such a restriction is impermissible under applicable laws, the User may not, without our written agreement:

  • license, sell, transfer, assign, distribute, host, or otherwise commercially exploit the Services;
  • modify, prepare derivative works of, disassemble, decompile, or reverse engineer any part of the Services; and/or
  • access the Services in order to build a similar or competitive website, product, and/or service.

We are always improving our Services. This means we may add or remove features, products, or functionalities; we will try to notify the User beforehand, but that won’t always be possible. We reserve the right to modify, suspend, or discontinue the Services (in whole or in part) at any time, with or without notice to you. Any future release, update, or other addition to functionality of the Services will be subject to these Terms of Use, which may be updated from time to time. The User agrees that we will not be liable to the Users and/or to any third party for any modification, suspension, or discontinuation of the Services or any part thereof.

5. User Content and User License Terms

The User may upload and publish information and content with the User Account through the Services (hereinafter "User Content"). The User Content can be in the form of print files (.gcode), 3D models files (such as .stl, .3mf, .obj and .amf) and related images (.jpg, .png, .gif, .TIFF), or any format supported by MakerWorld through the Services.

 

By uploading User Content using the Services, the User warrants that the User has all rights to the User Content to, for example and without limitation, distribute the User Content and sub-license the User Content subject to these User license terms through the Services.

If it is reasonably determined that the User Content violates or potentially violates the intellectual property rights (the "IP Rights") of a third party, MakerWorld will remove the User Content provisionally or permanently. The User is fully responsible for all of the User Content that the User uploads to and publishes through MakerWorld. By uploading the User Content, the User agrees to indemnify and hold MakerWorld harmless for any allegations and/or findings of infringement of IP Rights and/or any damages incurred therefrom.

The User retains any and all IP Rights in the User Content that the User may have. MakerWorld does not claim ownership of the User Content. The User is solely responsible for the User Content and assumes any and all risks associated with use of the User Content, including any reliance on its accuracy, completeness, or usefulness by others, or any disclosure of the User Content by the User that makes the User or any third party personally identifiable.

Unless MakerWorld states otherwise in writing to the User, the User may not state or imply that the User Content is in any way provided, sponsored, or endorsed by MakerWorld. MakerWorld is not obligated to backup any of the User Content and the User Content may be deleted at any time. The User is solely responsible for creating backup copies of the User Content if the User desires.     

 

MakerWorld does not grant any licence to the Users for the User Content, when uploading User Content to the Services for publication and distribution, the User is required to select a type of License from a set of License Terms including without limitation the Creative Commons License (CCLs) (the "Free Licenses"). Other Users of the Services can access and use the User Content per the Free License selected by you. The issue of User Content through the Service represents a proposal to enter into a licence agreement under the selected terms and conditions of the Free Licence selected by the User vis-à-vis other Users. The User acknowledges that the Free Licences are irrevocable after publication of the User Content.

 

By uploading and publishing User Content through the Services, the User represents and warrants that they have all rights, power, and authority necessary to further distribute, license, and/or sub-license the User Content to MakerWorld and other Users under a Free Licence selected by the User. Because the User alone is responsible for User Content, the User may expose themselves to liability, if the User posts or shares User Content without all necessary rights.

Furthermore, the User is prohibited from using the Services to publish and distribute User Content that can be used for creating items the possession or manufacture of which is restricted or prohibited by any applicable laws and/or regulations. In addition, the User agrees not to use the Services to display any User Content of low quality, intentionally erroneous, or with an incorrect label or description.  

By uploading and publishing the User Content to using the Service, the User grants to MakerWorld a worldwide, royalty-free and non-exclusive license to the User Content with the ability to sub-license for, for example and without limitation, the reproduction and distribution of the User Content, as well as displaying the User Content to the public worldwide and for the duration of the proprietary rights to the User Content. MakerWorld may use and sub-license the User Content, for example and without limitation, for the purpose of operating and promoting the Services and other services of MakerWorld.

The User understands and agrees that User Content is created and/or published by Users of the Services. The User Content is in no way inspected, tested, or otherwise quality controlled by MakerWorld. Hence, MakerWorld provides no representations, guarantees, warranties, or indemnification as to the User Content and any damages resulting from the User’s use of User Content published though the Services. For example, and without limitation, MakerWorld provides no representations, guarantees, warranties, or indemnification as to the descriptions and labelling of User Content published through the Services, or any factual, technical and formal inaccuracies or errors. MakerWorld provides no representations, guarantees, warranties, or indemnification as to the quality or flawlessness of the User Content and shall not be liable to any User for any damage incurred as a result of using User Content published through the Services.

 

Any and all reports concerning defective content, including User Content, may be notified to MakerWorld using the e-mail address support@makerworld.com  or reported using the "REPORT" button if available for a specific User Content or other User Content.

Any and all complaints concerning unauthorized content, including User Content, may be reported using the "Report Copyright Issue" button if available for a specific User Content or other User Content. When filing a complaint by clicking on the "Report Copyright Issue" button, you will be required to provide the following information: the original model link, a detailed description of the issue, and relevant images to substantiate the claim of infringement. While MakerWorld enables User Content to be uploaded to and stored using the Services, MakerWorld is NOT a data storage service provider. MakerWorld will make reasonable efforts to safeguard and backup User Content and to make User Content available in case of loss or deletion. However, MakerWorld does not guarantee to the User that the User Content will not be damaged, modified or deleted. MakerWorld has no responsibility or liability for the deletion, failure to store, or security of any User Content, including your User Content, and shall not be liable to the User for any damage incurred as a result of the loss of uploaded data including, but not limited to, User Content.

6. Third-Party Content

The Services may contain links to, for example and without limitation, third-party websites, products, or services (collectively, "Third-Party Content"), which may be posted by advertisers, our affiliates, our partners, or other users. Third-Party Content is not under the control of MakerWorld, and MakerWorld is not responsible for any Third-Party Content. You can choose whether to access these Third-Party Content and use of any Third-Party Content is at your own risk and the User should make any investigation of diligence that the User believes necessary before proceeding with any use and/or transaction in connection with such Third-Party Content.

7. Rewards Program

MakerWorld may periodically hold various events and promotions for users of its services. These events and promotions may include rewards programs, which offer eligible participants the opportunity to earn points or other benefits that can be redeemed for discounts, products, or other incentives ("Rewards").

If you upload and publish user content through the Services that have complied with all relevant obligations and not be in breach or suspected breach of the program terms (if any), these Terms of use, or any other applicable policies (such as the Community Guidelines), you may be eligible to receive rewards provided by MakerWorld.

MakerWorld reserves the right to change, remove, discontinue or otherwise alter eligibility criteria, point values, eligible products, redemption requirements and any related terms or any policy, FAQ, or guideline pertaining to MakerWorld Rewards, in whole or in part, at any time and in its sole discretion. Any changes or modifications will be effective immediately and may be posted to makerworld.com, so please check back from time to time. You waive any right you may have to receive specific notice of such changes or modifications, and your continued access to or participation in MakerWorld Rewards following any such changes or modifications confirms your acceptance. If you do not agree to these Terms of Use, you must stop accessing and participating in MakerWorld Rewards.

You have no property rights in points, and points can only be used as described here. Points have no cash, monetary, or other value, and cannot be redeemed in whole or in part for cash. Your points balance or any part of it is not transferable, cannot be divided as part of a settlement, legal proceeding or death, and cannot be combined with points of any other member in the program. Points may not be brokered, bartered, attached, pledged, gifted, or sold.

We may partly or fully suspend or terminate your access to a program or access to Rewards without notice that you have collected if:

  • We have objective grounds to reasonably believe that you upload and publish unauthorized user content, which may infringe upon the intellectual property rights of the third party;
  • We have objective grounds to reasonably believe that you have taken fraudulent activity includes any action that is deceptive or an attempt to gain points not in accordance with these Terms of Use and includes but is not limited to, circumventing, disabling, or fraudulently receiving points through any means or interfering with any part of the Services (or attempting to do so);
  • We have reasonable grounds to believe that you have obtained points repeatedly or unfairly through means such as repeatedly uploading models, exploiting system vulnerabilities, tampering with the process or the operation of a program and so on;
  • We have reasonable grounds to believe that you have caused or encouraged inaccurate measurements of genuine user engagement with the Services, such as by paying people or providing incentives to increase a user content’s views, likes, ratings, or to increase subscribers, downloads, otherwise manipulate metrics in any manner;  
  • We determine, acting reasonably, that you are in material or repeated breach of the program terms, our Terms of Use or the other related regulations or guidelines (such as the Community Guideline);
  • We are required to do so in response to a valid legal process or request.

If your participation in a program is terminated for these reasons, we may, acting reasonably, deduct wholly or partially your Rewards balance or otherwise not award any Rewards. Where appropriate and legally permissible, we will tell you if we suspend or terminate your access to a Program. If you think we have made a mistake in suspending or terminating your access to a Program, then you can appeal by emailing us at support@makerworld.com.

We may partly or fully terminate or suspend a program by giving you reasonable notice, including for the following:

  • There are changes in circumstances beyond our reasonable control,such as  technical problems with a program that cannot be resolved within a reasonable time, caused any abnormalities, losses or errors in the points data. We will make reasonable efforts (as determined by MakerWorld) to back up points data and to promptly address any issues that may arise. However, we cannot guarantee that the points data will be completely free from abnormalities, losses, or errors. As such, we cannot be held responsible or liable for any abnormalities, losses, or errors in the points data.
  • Where changes in relevant law, a court decision or a decision by a regulatory authority prohibits a program in part or in full.

If we partly or fully terminate or suspend a program for any of the above reasons, you may use the accrued points that you are entitled to under the program terms, unless prohibited from doing so by a court or regulatory authority.

8. Other MakerWorld Services

Users are entitled to use other services made available through the Services. For example, the "Open in Bambu Studio" function is supported by Bambu Lab services and products. You shall be solely responsible for the compliance of the related and applicable terms of use and assume any and all risks associated with such use. Other services are aimed at supporting collaboration and the 3D printing community. These other services may include different communication tools and content sharing tools. For example, Users are entitled to "Follow" activities of other Users, and other Users can follow the activities and content displayed by you.

Any activities that are suspected of being in violation of the Terms of Use can be directly reported to MakerWorld using the REPORT button, or if this is not possible, the Users can send information or your request directly to the e-mail address support@makerworld.com.

9. Intellectual Property

The Services are owned and operated by MakerWorld. The visual interfaces, graphics, design, compilation, information, data, computer code, products, services, trademarks, and all other elements of the Services (collectively, "Materials") provided by MakerWorld are protected by intellectual property and other laws. All Materials included in the Services are the property of MakerWorld or its third-party licensors.  Except as expressly authorized by MakerWorld, the User may not make use of the Materials. MakerWorld reserves all rights to the Materials not expressly granted in these Terms of Use.

10. Indemnity

Except to the extent prohibited by law, the User agrees to defend, indemnify, and hold MakerWorld, its affiliates, and their respective, directors, officers, employees, , agents, contractors, third-party service providers, and licensors (collectively, "MakerWorld Entities") harmless from and against any claim or demand made by any third party, and any related liability, damage, loss, and expense (including costs and attorneys’ fees) due to, arising out of, or in connection with: (a) the User's use of the Services, (b) the User's violation of the Terms of Use, (c) the User's violation of any applicable laws or regulations, and/or (d) the User's User Content. MakerWorld reserves the right to control the defense of any matter for which the User is required to indemnify any of the MakerWorld Entities, and the User agrees to cooperate with the defense of such claims.

11. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS-IS" AND "AS AVAILABLE" AND MAKERWORLD (AND MAKERWORLD ENTITIES) EXPRESSLY DISCLAIM ANY WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON INFRINGEMENT. MAKERWORLD (AND MAKERWORLD ENTITIES) MAKE NO WARRANTY THAT THE SERVICES: (A) WILL MEET THE USER'S REQUIREMENTS; (B) WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; OR (C) WILL BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE.

MAKERWORLD ASSUMES NO RESPONSIBILITY, NOR WILL BE LIABLE, FOR ANY DAMAGES TO, OR ANY VIRUSES OR MALWARE THAT MAY INFECT THE USER'S COMPUTER, TELECOMMUNICATION EQUIPMENT, OR OTHER PROPERTY CAUSED BY OR ARISING FROM THE USER'S ACCESS TO, USE OF, OR BROWSING THE SERVICES, OR THE USER'S DOWNLOADING OF ANY INFORMATION OR MATERIALS FROM THE SERVICES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO THE USER DEPENDING ON THE JURISDICTION.

IN NO EVENT SHALL MAKERWORLD (AND/OR ANY MAKERWORLD ENTITY) BE LIABLE TO THE USER OR ANY THIRD PARTY FOR ANY LOST PROFIT OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THESE TERMS OF USE OR THE USER'S USE OF, OR INABILITY TO USE, MAKERWORLD OR SERVICES OR THIRD-PARTY SITES OR APIS EVEN IF MAKERWORLD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ACCESS TO, AND USE OF, MAKERWORLD AND SERVICES AND APIS AND OTHER CONTENT ARE AT THE USER'S OWN DISCRETION AND RISK, AND THE USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO THE USER'S COMPUTER SYSTEM OR LOSS OF DATA RESULTING THEREFROM.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO THE USER, IF ANY,  FOR ANY DAMAGES ARISING FROM OR RELATED TO THESE TERMS OF USE (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION), WILL AT ALL TIMES BE LIMITED TO THE GREATER OF (A) FIFTY US DOLLARS ($50); OR (B) AMOUNTS THE USER HAS PAID US IN THE PRIOR 12 MONTHS (IF ANY). THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT. THE USER AGREES THAT OUR SUPPLIERS WILL HAVE NO LIABILITY OF ANY KIND ARISING FROM OR RELATING TO THESE TERMS OF USE.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OF CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO THE USER, DEPENDING ON JURISDICTION.

12. Changes to these Terms

The Terms of Use may be unilaterally modified or updated by MakerWorld at any time. MakerWorld shall notify the User of any change to the Terms of Use at least 7 days before the effective date of the updated Terms of Use, by publishing the updated Terms of Use through the Services, for example and without limitation, on MakerWorld’s website or by means of a message sent to the User’s registered e-mail address. The User may reject the relevant changes by deleting his or her User Account or by not using the Services. The valid and effective version of Terms of Use is always published on MakerWorld’s website at Terms of Use, and the User is obliged to become acquainted with the Terms of Use from time to time. If the User continues to use the Services after the effective date of the changes, it is deemed that the User has agreed to accepted the changes.

13. Additional Terms

Because MakerWorld offers a variety of services including the Services through itself and third-party service providers, the User may be asked to agree to additional terms, policies, guidelines, or rules before using a specific product or service offered through or together with the Services by third-party service providers such as Bambu Lab (collectively, "Additional Terms"). All Additional Terms are incorporated by this reference into, and made a part of, these Terms, and to the extent any Additional Terms conflict with these Terms, the Additional Terms govern with respect to your use of the corresponding Services. For the use of Bambu Lab services and products (including without limitation the Bambu Store, Bambu Handy, and Bambu Studio), is subject to, among other things, compliance with all terms of service, including these Terms of Use, Privacy Policy and the additional information available in your Bambu Lab Account Service.

14. Governing Law and Venue

The validation, interpretation, modification, fulfillment, and dispute settlement of the Terms of Use are governed by the laws of Singapore. If any dispute arises concerning the content or performance of the Terms of Use, the dispute shall be settled through friendly negotiation. In the event that the dispute cannot be settled through negotiation, either party could submit the dispute to Singapore International Arbitration Centre (SIAC) for arbitration which shall be conducted in accordance with the SIAC's arbitration rules in effect at the time of applying for arbitration. The arbitral tribunal shall consist of three (3) arbitrators. MakerWorld and the Users shall be entitled to appoint one arbitrator, and the third arbitrator shall be jointly appointed by SIAC. The language of the arbitration is English and is conducted in Singapore city. All arbitrators must be proficient in English. The arbitral award is final and binding upon both MakerWorld and you.

15. Termination

The User may terminate their agreement to and acceptance of the Terms of Use at any time and for any reason by discontinuing use of all Services and deleting your User Account. If the User stops using the Services without deleting your User Account, your User Account will not be deleted automatically by MakerWorld. To the fullest extent permitted by applicable law, we may suspend or terminate your User Account, moderator status, or ability to access or use the Services at any time for any or no reason, including for violating this Terms of Use.

The following sections will survive any termination of the Terms of Use or of your Account: 5 (User Content and User License Terms), 9(Intellectual Property), 10 (Indemnity), 11 (Disclaimers and Limitation of Liability), 15 (Termination), and 16 (Miscellaneous).

16. Miscellaneous

The Terms of Use, together with the Privacy Policy and any other agreements expressly incorporated by reference into these Terms of Use, constitute the entire agreement between the User and MakerWorld regarding the User's access to and use of the Services. MakerWorld's failure to exercise or enforce any right or provision of the Terms of Use will not operate as a waiver of such right or provision. If any part of the Terms of Use is held to be invalid or unenforceable, the unenforceable part will be given effect to the greatest extent possible, and the remaining parts will remain in full force and effect. The User may not assign or transfer any rights or obligations under the Terms of Use without MakerWorld’s prior written consent. MakerWorld may, without restriction, assign any of MakerWorld's rights and obligations under the Terms of Use, at its sole discretion, with 30 days’ prior notice. The User's right to terminate the Terms of Use at any time pursuant to Section 14 remains unaffected.

18. Final provisions

  1. This Terms of Use of makerworld.com forms an integral part of the General Terms of Use and the Privacy Policy of Bambu Lab.
  2. This Terms of Use of makerworld.com enters into effect on September 22, 2023.
